  • For defending his parents: A young Hispanic man shot and killed another Hispanic who inappropriately touched his mother and hit his father in a restaurant.
  • The Houston Police Department decided not to press charges against the young man, who allegedly acted in self-defense.
  • The story took place in the Ostionería Michoacán, a very popular place among Hispanics in the city.

A young Hispanic man shot and killed another man who inappropriately touched his mother and beat his father at Ostionería Michoacán.

According to Houston Police Department (HPD) the incident occurred in the parking lot of the Michoacán Ostionería from 12810 Gulf Freeway in South Houston.

The event was at dawn on Friday, September 25, at the restaurant, which is a very popular meeting place for Hispanics in the city because they have live music as well as food and beverage service.

Inside the place was Alfredo Rodríguez, who was chatting with his wife and son on a family night.

According to Tony Mosqueda, a popular Houston DJ who was a patron that night at Ostionería Michoacán, the place was so packed with patrons that you could barely walk between the tables.

The narcocorrido music was blaring and outside in the parking lot several boys were accelerating their trucks at full speed and with the music from their stereos blaring at full volume.

“I arrived with two friends, but it felt a very strange vibe, we felt uncomfortable, like with a bad feeling … we asked for a mineral water and two Margaritas (a drink with tequila) but then we left”, Mosqueda details, in a telephone interview , about that night.

Faced with a Texas ban on closing bars due to the coronavirus pandemic, many restaurants that sell alcohol have become the new meeting and entertainment centers in Houston.

Suddenly, Rodríguez’s wife was walking between the tables, it is not known with certainty where she was going inside the place, when a Hispanic man stood up and suddenly held her firmly by the buttocks.

The woman was surprised by what the man, who was allegedly with a group of boys at a table, just did, and demanded his behavior. The woman was so angry that she slapped him a couple of times.

Rodríguez managed to see what was happening with his wife and he claimed his actions from the other man who, with the company of the other friends, became emboldened and there was an exchange of shoves and insults that did not happen to adults.

The woman convinced her husband to leave things as they were and not to get into fights with the man who had attacked her. The couple’s son was also at the scene but at that moment they decided to do nothing.

At 1:50 in the morning of Friday the 25th the couple decided to leave the restaurant that was already beginning to empty of customers after the night out.

However, outside the Ostionería Michoacana the couple and their son met the group of men, including the guy who had touched the woman.

Again there were insults and yelling. At one point, the man who had touched the woman approached the couple and got into a fight with Rodríguez.

Rodríguez’s wife wanted to intervene to separate her husband but the other man pushed her. In the middle of the fight, Rodríguez received a punch that knocked him to the ground completely. Some witnesses say that the attacker struck the other when he was already on the ground.

The son of the couple, very upset, seeing what they had just done to his parents, ran to the family car and pulled out a gun. He ran back to where the man was beating his father and fired several shots at him.

The shots hit the man who had touched the woman, who fell dead at the scene. His friends, who were with him when the events occurred, ran out when they saw that he was shot to death.

The boy who shot, whose name HPD did not reveal, stayed at the scene after he killed his mother’s attacker and asked witnesses for someone to call authorities.

The agents of the HPD Homicide Division arrived at the scene to investigate the case and the first thing they did was to interview, separately, the family involved in the incident.

According to the legal documents of the case, the agents of the Homicide Division reviewed all the videos of the security cameras of the Ostionería Michoacana and verified that the incident in which the man grabs his buttocks was true.

Outside, HPD officers also checked the parking lot security cameras and saw how the family’s narration matched what was seen in the footage.

However, only by forensic expertise did the authorities seize the pistol to rule out that it had not been used in other violent acts.

Until the moment of writing this story, the name of the deceased is not known with certainty because the forensic authorities have not released it. Some witnesses identified him as Mario and others as Ramiro, 39 years old.

According to HPD, Alfredo Rodríguez’s family was allowed to leave the scene after it was found that the boy killed the other man in legitimate defense. Anyway the case will be reviewed by the Harris County Attorney’s Office to define responsibilities.
