Salvador Domingo Dueñez Jr. is accused of leaving a weapon within reach of a child after his son was accidentally killed. Three-year-old Troy Blue Dueñez was shot dead after he found the gun that his father Salvador Domingo Dueñez Jr. had left loaded, without the safety on within reach of the little boy resulting in a terrible family tragedy.

The defendant Salvador Domingo Dueñez Jr., 25, has been detained in the Hidalgo County prison in southeastern Texas, almost on the border with Mexico. He is accused of the felony of allowing access to a firearm to a minor and aggravated assault with a deadly weapon. The crime has shocked the Texas town of Elsa.

According to the legal documents regarding the case, the detainee Salvador Domingo Dueñez Jr. voluntarily surrendered to the authorities after his son Troy Blue Dueñez died from a bullet wound to the chest suffered while he was playing with the weapon that had been left out. It is not detailed in the documents if the weapon legally belonged to the father.

Robert McGinnis, Chief of the Elsa Police Department (EPD) explained in a statement that the death of the little Troy Blue Dueñez was a «tragic accident» and urged the community in southeast Texas never to leave the family’s weapons within reach of small children.

Although the death of little Troy Blue Dueñez was classified as an accidental shooting, his father, Salvador Domingo Dueñez Jr., will have to answer to the law for having left the gun within reach of his young son resulting in a totally preventable tragedy.

The mother of Troy Blue Dueñez was separated from the child’s father at the time that the tragedy occurred due to the negligence of Salvador Domingo Dueñez Jr. The case is even more dramatic because on the day of the child’s funeral the relatives of his father and mother got involved in a huge fight with both families.

Last Monday, October 18 at 2:14 in the afternoon, the EPD emergency services received a call requesting the urgent presence of police and paramedics at a home located at 208 Begonia Street where, according to the person who made the call, a child had been wounded by a gunshot.

When the police and paramedics arrived at the home of little Troy Blue Dueñez, they found him badly wounded by a bullet to the chest from a .9-millimeter caliber pistol. At the Salvador Domingo Dueñez Jr. house, the boy’s father testified that his son had taken the gun and shot himself.

Little Troy Blue Dueñez’s medical condition was so serious that paramedics took him to the emergency department of DHR Hospital, in the neighboring city of Edinburg in Texas. There the doctors tried to save his life despite his critical condition after having been shot.

However, when little Troy Blue Dueñez got to the emergency room, the doctors could not do anything to save him and the little boy died due to the severity of his injuries. At that time, the EPD classified his death as accidental and his father Salvador Domingo Dueñez Jr. did not initially face charges.

EPD detectives opened an investigation to discover the details about the sequence of events that led to little Troy Blue Dueñez playing with a .9-millimeter caliber pistol that had been left loaded and unsecured, at the home of his father Salvador Domingo Dueñez Jr. without his father realizing it until it went off.

Janett Rivera, the mother of Troy Blue Dueñez, gave an interview to KRGV 5 News in southeastern Texas where she revealed that she and Salvador Domingo Dueñez Jr. were no longer in a relationship though they had had a child together.

Troy Blue Dueñez’s mother said her son’s death was, «like a dream from which she wants to wake up.» The woman stated that, during the month prior to her son’s death, Salvador Domingo Dueñez Jr. had not seen the child, who had been in her custody, because of restrictions due to the coronavirus pandemic.

“I wish this had never happened. I wish I had never let him see my children… it was like any other normal day, but I received a call and everything went wrong,” said Janett Rivera about the moment she found out that her son Troy Blue Dueñez had died while he was in custody of his father Salvador Domingo Dueñez Jr.

The tragic death of little Troy Blue Dueñez was made even worse during his funeral last Thursday, October 21, 2021 in the Sala Exit Funeral Home, in Elsa, when the relatives of Salvador Domingo Dueñez Jr. and Janet Rivera got into a huge fight in the middle of the mass and funeral of the little dead child.

The EPD arrested 23-year-old Anthony Marcus Dueñez; Blake Solís, 28 years old; Gon Anna Vargas, 49 years old; Janay Marie Vargas, 30 years old; Jenna Anna Marie Kayla Dueñez, 26, and Emilio Oviedo Jr., 37, each charged with one count of aggravated assault with injuries in the middle of a fight.

After several days of investigations, the EPD agents issued an arrest warrant for Salvador Domingo Dueñez Jr. for the crimes of aggravated assault with a deadly weapon and for allowing a minor to have access to a gun that ultimately caused the death of little Troy Blue Dueñez.

According to the Penal Code of the State of Texas, a single charge of aggravated assault with a deadly weapon like the one faced by Salvador Domingo Dueñez Jr. is punishable by a sentence of 2 to 10 years in prison for anyone who is found guilty of the crime. In this case, the charge may be aggravated due to the death of the child.

When the EPD issued the arrest warrant against Salvador Domingo Dueñez Jr., he turned himself in by walking into the department’s headquarters to surrender to the authorities. He is currently in the Hidalgo County jail in southeastern Texas waiting to face criminal prosecution.

Criminal records in Texas, consulted by MundoHispánico, detail that the defendant Salvador Domingo Dueñez Jr. has already had other run-ins with the law over gun related crimes. He was arrested in 2015 and 2017 for firing a gun at other people, though without causing injury.

The death of Troy Blue Dueñez with a gun in the home of his father Salvador Domingo Dueñez Jr. is just one more case of gun violence in the United States. The non-profit organization National Archive of Gun Violence reports that so far in 2021, 39,007 people have already been shot dead.

As of Sunday, November 14, 2o21, of those people who have been shot dead in the United States, a total of 18,019 were murdered and 20,988 committed suicide. 35,735 were injured. The country has already experienced 621 mass shootings, in which at least four people died in the same event.
