THE LATEST: Leaked draft of Supreme Court opinion that would overturn abortion rights. The US Supreme Court is preparing to revoke abortion rights that have been in force in the country since 1973. This, according to the unusual leak of a draft opinion from the highest court published by Politico on Monday.

This is a draft of the majority opinion of the Supreme Court signed by Justice Samuel Alito, according to EFE. Along with Alito, Justice Clarence Thomas and the justices appointed by former President Donald Trump — Neil M. Gorsuch, Brett M. Kavanaugh and Amy Coney Barrett — have apparently decided to overturn Roe v. Wade and revoke abortion rights in the United States.

The country’s highest court has six conservative and three liberal judges. “It is time to heed the Constitution and return the issue of abortion to the people’s elected representatives,” said the document obtained by Politico.

Being a draft, however, the decision could still change and an official verdict is not expected until June. The leaking of a Supreme Court opinion on such a controversial, and still ongoing case, is unprecedented  in recent US history.

Abortion has been legal in the US since the Supreme Court ruled in 1973 that the State has no right to intervene in a woman’s decisions about her pregnancy. In the past decade, numerous conservative-led states have passed laws that blatantly violate those parameters, with the stated goal of getting the Supreme Court to review and overturn nearly half-century-old precedent.

It is unknown if the draft opinion represents the final word of the highest court on this matter, as opinions often vary during the drafting process, AP notes. Whatever the outcome, Politico’s report represents an extremely rare glimpse into the court’s confidential deliberative process, particularly in a case of such importance.

“It was egregiously wrong from the start.,” says the draft opinion. The draft is signed by Judge Samuel Alito, a member of the court’s conservative majority. Alito was nominated by former President George W. Bush.

The document was called “the first draft” of the “court opinion” in a case challenging Mississippi’s ban on abortion after 15 weeks of pregnancy, known as Dobbs v. Jackson Women’s Health Organization.

The court is scheduled to rule on the case in late June or early July, before its session expires. In practical terms, the draft opinion asserts that there is no constitutional right to abortion services, and would allow each state to more strictly regulate the procedure or ban it altogether.

“We hold that Roe and Casey must be overruled,” he adds, referring to the 1992 Planned Parenthood v.
